Welcome to Tohfa. These terms set out the agreement between you and us when you use tohfa.af to order gifts for delivery in Afghanistan. By placing an order, you agree to these terms.
1. Who can order
You must be at least 18 years old. By ordering, you confirm that the recipient details you provide (name, address, phone number) are accurate and that the recipient consents to receiving the gift.
2. Orders and acceptance
When you place an order, we send an order confirmation by WhatsApp or email. Our acceptance happens when we mark the order as “Preparing.” Up until that point, we may decline an order for any reasonable reason — for example, the recipient address is incomplete, the requested cake design is impossible to execute, or the order appears fraudulent.
3. Prices and payment
Prices are listed in US Dollars. The price you see at checkout is the total — delivery within Kabul is included, plus any add-ons or cash gift you opted into.
Payment is processed by Stripe. Your card details are sent directly to Stripe; we never see, store, or transmit them. If your payment fails, your order is not confirmed and we will not start preparing it.
Same-day express delivery, when available, carries a small surcharge shown at checkout. Cash-gift add-ons carry a 5% service fee.
4. Delivery
We hand-deliver every order within Kabul. Standard delivery is next-day; same-day express is available for most items if ordered before 3 PM Kabul time; food orders deliver in 2-4 hour windows; custom cakes need at least 12 hours lead time.
Our courier calls the recipient before arriving. If the recipient is not home, we reschedule for later the same day or the next morning at no charge. We do not leave gifts unattended at a door.
Delivery to cities outside Kabul is announced on the relevant city pages as it becomes available.
We are not responsible for delays caused by events outside our control: severe weather, security incidents, road closures, power outages, or anything else that meaningfully prevents safe delivery on the planned date. In those cases, we reschedule with you to the soonest practical date. See our Refund Policy for the specific cases in which a refund applies.
5. Cancellation and refunds
You can cancel or change your order until we mark it as “Preparing.” After that point, the bakery, kitchen, or florist has started work and we cannot refund. Cash gifts attached to a cancelled order are returned in full.

6. Personal messages and custom content
You retain ownership of any personal message, cake-design notes, or other content you send us. By submitting it, you grant us a limited licence to use that content for the purpose of fulfilling your order. We will not publish, share, or commercialise it.
Content must not be illegal, defamatory, discriminatory, or contain hate speech. We reserve the right to refuse to deliver a message that crosses those lines.
7. Cash gifts
Cash gifts are limited to $200 USD or 2,500 AFN per order. For higher amounts, message us via WhatsApp first. Cash is delivered in a sealed envelope alongside your physical gift. The recipient signs / acknowledges receipt.
We are licensed to facilitate gift-related cash deliveries within Afghanistan. We are not a money-transfer service for general purposes.
8. Add-ons
Add-ons (balloons, message cards, occasion-specific extras) attach to a single order line. If you order three cakes and want a balloon with each, add the cake to your cart three times — quantity multiplication doesn't multiply add-ons.
9. Intellectual property
The Tohfa name, logo, product photos, and site content are ours. You may not copy, reproduce, or use them commercially without written permission.
10. Disclaimers and liability
We provide the service with reasonable skill and care. Where the law allows, our liability for any single order is capped at the amount you paid for that order. Nothing in these terms limits liability for fraud, gross negligence, or where local law prohibits a cap.
11. Changes to these terms
We may update these terms over time. The “last updated” date above reflects when. Material changes will be highlighted on the site or emailed to recent customers.
12. Governing law and contact
These terms are governed by the laws of Afghanistan. Disputes we can't resolve through friendly conversation are subject to the courts of Kabul.
